Terms of Use, Training Consent & Disclaimer

These Terms of Use (“Terms”) govern your access to and use of the GonePhishing website, platform, applications, and services (“Service”). By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Purpose of the Service

GonePhishing provides cybersecurity awareness education and training, including informational content and simulated phishing exercises delivered via email, SMS, and web-based scenarios. All materials are provided solely for educational and awareness purposes and do not constitute legal, financial, or professional advice.

2. Training Consent & Simulated Phishing

By using the Service, you expressly acknowledge and consent that you may receive simulated phishing communications, including emails and SMS messages, as part of cybersecurity training. These simulations are intended solely for education and awareness and are not designed to cause real-world harm.

• Link-clicking behavior
• URL and domain inspection
• Sender name or address recognition
• Phishing reporting behavior

Simulated landing pages may resemble login or data-entry pages for training purposes only. Any credential fields presented during simulations are simulated only. Credentials entered into simulated training pages are not stored, reused, authenticated against real systems, or accessed for any purpose other than training feedback. This limitation applies only to training simulations and does not apply to normal account authentication required to access the Service.

3. Eligibility & Minors

The Service is intended for users thirteen (13) years of age or older. Children under 13 may not independently use the Service. Minors aged 13–17 may participate only when enrolled or authorized by a parent, legal guardian, school, or other responsible adult or organization.

By authorizing a minor’s participation, the parent, guardian, or authorized organization represents that they have legal authority to provide consent and accept responsibility for appropriate supervision.

4. User Types & Enrollment

Individual / Public Users: Participation is voluntary and self-directed. Training results are visible only to the individual user.

Organizational / Corporate Users: Users enrolled through an organization acknowledge that the organization has authorized participation as part of training. Organizational administrators represent that they have authority to enroll users. Training results may be visible to designated administrators in aggregate or authorized form. GonePhishing does not control how organizations use training results for employment or disciplinary purposes.

5. SMS Messaging & Opt-Out

If you participate in SMS-based training, messages are sent for training purposes only. Message frequency is limited. You may opt out at any time by replying STOP. Message and data rates may apply.

6. Acceptable Use

You agree not to misuse the Service, attempt unauthorized access, conduct real-world phishing, or use training materials for illegal or harmful purposes. Violations may result in suspension or termination of access.

7. Data Handling & Privacy

GonePhishing collects only the minimum information necessary to deliver training and measure educational outcomes. Passwords entered during simulations are never stored. 8. Intellectual Property

All content, software, simulations, designs, logos, and branding are the property of GonePhishing or its licensors and are protected by applicable intellectual property laws.

9. No Guarantee of Compliance

GonePhishing supports cybersecurity awareness efforts but does not guarantee regulatory compliance, certification, or audit outcomes.

10. Limitation of Liability

To the fullest extent permitted by law, GonePhishing shall not be liable for damages arising from use of the Service, participation in training simulations, or training outcomes.

11. Indemnification

You agree to defend, indemnify, and hold harmless GonePhishing and its affiliates from claims arising from your use or misuse of the Service, violation of these Terms, or violation of applicable laws.

12. Governing Law

These Terms are governed by the laws of the State of [Your State].

13. Changes to These Terms

GonePhishing may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.
