0. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the GonePhishing website, platform, applications, training content, simulations, articles, tools, and related services (the “Service”), operated by GonePhishing LLC. By accessing, browsing, or using any portion of the Service — including public content such as articles and tools — you agree to be legally bound by these Terms. If you do not agree, you may not use the Service.

1. Educational Purpose Only

GonePhishing LLC provides cybersecurity awareness training, simulations, recovery guidance, and educational tools for informational purposes only. Nothing on this platform constitutes legal, financial, regulatory, compliance, or professional advice.

All materials are general in nature and are not tailored to any specific incident, individual, or organization. Every cybersecurity event, fraud scenario, and scam situation is different.

Use of the Service does not guarantee prevention of loss, regulatory compliance, successful recovery of funds, or protection from future incidents. Users remain solely responsible for evaluating their circumstances and seeking appropriate professional advice when necessary.

2. Fraud Recovery Guidance Disclaimer

Any “what to do” guidance, checklists, identity theft steps, dispute suggestions, or recovery recommendations are general educational information only. GonePhishing LLC does not guarantee successful recovery of funds, reversal of payments, dispute resolution outcomes, identity restoration, or prevention of future incidents. You are responsible for confirming appropriate steps for your situation with your financial institution, service provider, law enforcement, or qualified professional.

3. Training Consent & Simulated Phishing

By using the Service, you acknowledge and consent to receiving simulated phishing emails (opt-in optional), SMS messages (opt-in optional), and web-based exercises for training purposes. These are controlled simulations designed for awareness and education only.

Credentials entered into simulated training pages are not stored, reused, or authenticated against real systems.

4. Acceptable Use

You agree not to use the Service for unlawful, fraudulent, harassing, abusive, or malicious purposes. Simulated phishing tools, campaign features, and training content may only be used for authorized training and awareness purposes (for example, within your own organization and with appropriate permission). Any unauthorized or harmful use is strictly prohibited.

You agree not to attempt to bypass security controls, probe or scan the Service, disrupt Service operations, or access data that does not belong to you.

5. Intellectual Property

All content, training materials, simulations, templates, articles, designs, videos, graphics, trademarks, logos, and software provided on or through the Service are owned by GonePhishing LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Service without prior written permission, except as allowed by law.

6. No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

GonePhishing LLC expressly disclaims all warranties, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content
  • Uninterrupted or error-free operation

GonePhishing LLC does not warrant that training will prevent incidents, that guidance will resolve individual situations, or that the platform will operate without interruption.

7. Limitation of Liability

To the fullest extent permitted by law, GonePhishing LLC shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to financial loss, data loss, business interruption, reputational harm, or regulatory consequences, arising from:

  • Use or inability to use the Service
  • Reliance on training materials or recovery guidance
  • Participation in simulations
  • Alleged failure of the Service to prevent an incident
  • System errors, downtime, or technical malfunctions

8. Subscription & Refund Policy

Paid subscriptions are billed in advance on a recurring basis as selected. Unless otherwise stated in writing, subscription fees are non-refundable.

Organizations are responsible for managing seat quantities and subscription status. Failure to cancel prior to renewal will result in automatic renewal charges.

9. Service Interruption

GonePhishing LLC may experience temporary interruptions due to maintenance, technical issues, hosting provider outages, or unforeseen events. We do not guarantee continuous or uninterrupted access.

10. Force Majeure

GonePhishing LLC shall not be liable for failure or delay in performance due to causes beyond reasonable control, including but not limited to: natural disasters, cyberattacks, war, terrorism, labor disputes, government actions, power failures, or internet disruptions.

11. Indemnification

You agree to indemnify and hold harmless GonePhishing LLC, its owners, affiliates, and partners from any claims, damages, or legal expenses arising from your use or misuse of the Service.

13. Arbitration Agreement

Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in the State of South Dakota, in accordance with the rules of the American Arbitration Association.

Arbitration shall be conducted on an individual basis. The arbitrator's decision shall be final and binding.

14. Class Action Waiver

You agree that any claims against GonePhishing LLC must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict of law principles.

16. Changes to These Terms

GonePhishing LLC may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
